Terms & Conditions

These are the Terms and Conditions for all Booking of Entertainment and Equipment withGroove Night Avenue.

1. Definitions:
a.  Groove Night Avenue: Refers to band or acting agent for third party artist.
b.  Client: The person, organisation, company or other body which is hiring the
services and/or equipment as specified on the invoice.
c.  Artist: Performer, band, DJ
d.  Event date: The time and date of the event, confirmed by Groove Night Avenue
and noted on the invoice
e.  Booking Form: The invoice sent on behalf of the client and Groove Night
Avenue specifying details of the booking.
f.  Day: A calendar day, unless specified otherwise.

2. Booking confirmation
A booking is not confirmed until the client pays any costs as outlined under ‘Payments’ in these terms and conditions, and receives confirmation of the booking from Groove Night Avenue.

3. Payments
A non-refundable deposit of 30% of the total fee is payable to confirm a booking. The booking is not confirmed until the deposit is received by Groove Night Avenue. The balance of the booking cost is payable 7 days before the client’s event. If the balance of the booking cost is not received more than 7 days before the event date, Groove Night Avenue reserves the right to cancel the booking and the client will forfeit the deposit.

a.
 Additional performance time: If the client requests additional performance time in
excess of the time noted on the invoice, this is at the performers discretion and will
be billed to the client at the ‘additional time’ fee as stated on the invoice.

b.  ‘Cooling-off’ period: Client has seven days from the date of the booking
confirmation to change their mind and cancel the booking with full deposit refund.

4. Access, space & power requirements
The client shall ensure a safe and appropriate environment is provided for artist to perform. The client must ensure:

a. A space of 4m x 2m for band, 3m x 2m or more for DJ or solo performance
b. Access to 240v power within 10m of equipment
c. If an outdoor event, client must provide an undercover area if any chance of poor weather

5. Changes and cancellations
Requests for changes of the event date must be made atleast 120 days before the original event date. A date change is subject to availability of the performer on the suggested date. Date change will only be confirmed with a new invoice created by Groove Night Avenue and received by the client. All cancellations will result in
the client forfeiting the deposit, however if Groove Night Avenue is notified of cancellation more than 120 days before the event date, credit to the value of the deposit will be given to the client to use for any future booking made within 12 months of the date of cancellation. Cancellations made within 120 days of the event date will result in the client forfeiting all payments made to Groove Night Avenue.

6. Sound Equipment and Lighting
All artists provide quality sound and lighting. If client requires ‘specific’ or ‘special’ lighting and or smoke machines this will be negotiated at an additional cost to the client.

7. Damage to equipment
Any damage to the artist’s equipment during the event caused by the client, client’s guests or any other person in attendance at the event whether invited or not, will result in the total cost to repair/replace the equipment from the client.

8. Images
The client gives permission for any photos taken during the event to be used on Groove Night Avenue website and other promotional advertising.

9. Food
The customer agrees to supply the artist with an adequate meal at the event for all bookings in excess of 2 hours of performance time (2 performance hours typically refers to 4-5 hours including set up and pack down plus additional travel time).

10. Illness
In the event of serious illness, emergencies or ANY extenuating circumstances, Groove Night Avenue will substitute an artist to fulfill the obligations of the booking.

11. Indemnification
Groove Night Avenue will not be held responsible or liable for any circumstances outside their control. This includes, but is not limited to, fire, riot, civil commotion, accidents, electrocution, acts of nature and equipment failure. If such circumstances arise, all reasonable efforts will be made by Groove Night Avenue to provide replacement equipment. The client agrees that in all circumstances, Groove Night Avenue’s liability is limited to an amount equal to the booking cost and not be liable for indirect or consequential damages.

12. Terms and Conditions Agreement
The deposit received from the client will suffice that these terms and conditions have been read and adhered to.
