Conditions of entry
1. Information on how to enter and prizes form part of these conditions of entry. By entering, entrants accept these conditions.
2. Entry is open to all residents of Western Australia, except directors, officers, management and employees (and their immediate families) of the Promoter or of the agencies and companies associated with this competition.
3. The Promoter is Dean Anderson (ABN: 88 715 780 388) of 3 Cowra Turn, Averley and Scott Neasham (ABN:44 954 345 187 (ABN 17 434 286 169) of 132 Arlunya Ave, Cloverdale
4. The competition commences on 15th July 2017 at 11am, and concludes on 15th December 2017 at 5pm (Competition Period).
5. The prize shall consist of $500 in travel gift cards with the promoter making full endeavor into supplying the preferred carrier gift cards.
6. To enter, consumers must, during the Competition Period:
(a) Purchase a full priced entertainment service from either of the promotors and
(b) Secure their booking by way of a non-refundable 30% deposit (which form part of the day to day agreement of booking through the promoters)
7. All entries must be received during the Competition Period. Entries are deemed to be received at the time of receipt of the associated deposit.
8. Entries will be awarded on the following basis:
a) For every $150 spent the participant shall receive 1 entry
b) For posting on Facebook and liking and tagging both Groove Night Avenue and/or DJ Scott-e in a public post the participant will receive 1 additional entry
9. The participant is responsible for any costs associated with posting/liking on Facebook.
10. The participant is under no obligation to post/like or tag the promotors on Facebook.
11. If a participant cancels their booking the total number of entries will be reduced to 1 entry per $150 of the deposit paid.
12. The prize(s) must be taken as stated and no compensation will be payable if a winner is unable to use the prize(s) as stated. Prizes are not transferable, exchangeable and cannot be redeemed for cash. The Promoter accepts no responsibility for any variation in prize value. If a prize or any element of a prize is unavailable for any reason, the Promoter may substitute for that prize or element of that prize another item of equal or higher value as determined by the Promoter.
13. This competition is a game of chance; skill plays no part in determining the winner. The judges’ decision regarding all aspects of the competition is final and no correspondence will be entered into.
14. The winner will be notified by email and the name of the winner will be published on the Groove Night Avenue Facebook page on 18th December 2017 at 5.30pm.
15. The draw shall take place by way of a video webinar on the 18th December 2017 at 5pm and all participants will receive an invite to the webinar by email no later than the 15th December 2017
16. The draw will be by way of random draw and all records relating to the draw will be kept for a period of no less than 12 months.
17. The promotor will ensure the gift cards are valid for 12 months unless the chosen carrier has a different gift card expiry.
18. The gift cards are subject to any terms and conditions imposed by the prize supplier, including periods of validity.
19. The Promoter accepts no responsibility for late, lost incomplete, incorrectly submitted, delayed, corrupted or misdirected entries due to error, omission, tampering, deletion, theft, communications failure or otherwise. The Promoter is not responsible for any problems or technical malfunction of any nature associated with this competition. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred
20. Prize winners must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) surrounding the winning of any prize, free of charge, and they consent to the Promoter using their name and image in promotional material.
21. If for any reason any aspect of this competition is not capable of running as planned, including by reason of any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected entries with approval from the Gaming and Wagering Commission of Western Australia
22. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
23. Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage or delay in transit to the prize(s).
24. The Promoter may require the winner(s) to provide proof of identity, proof of age and proof of residency. Identification considered suitable for verification is at the Promoter’s discretion.
25. The Promoter reserves the right to amend any details with approval from the Gaming and Wagering Commission of Western Australia
26. This competition is in no way sponsored, endorsed or administered by, or associated with, Facebook.  Entrants are providing their information to the Promoter and not to Facebook.  Each entrant completely releases Facebook from any and all liability.
27. The Promoter is not liable for any tax implications arising from prize winnings. Independent financial advice should be sought. Where this competition involves, for GST purposes, supplies being made for non-monetary consideration, entrants will follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
28. The information entrants provide will be used by the Promoter for the purpose of conducting this competition. The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this competition or communicating with entrants. By entering this competition, entrants consent to the storage of their personal information on the Promoter’s database and the Promoter may use this information for future competition and marketing purposes, including contacting the entrant via electronic messaging. Entrants can request access to the personal information the Promoter holds about them by emailing the Promoter at deananderson@groovenightavenue.com.
